INTRODUCTION

VORK TECHNOLOGIES LIMITED (herein referred to as ‘the Company’) respects the privacy of its online guests and users of its products and services, VORK, with modules including but not limited to human resourcing, volunteering, payment system, performance analytics and training advertisement and complies with all laws necessary for the protection of your privacy.

DEFINITIONS

Any reference to personal data below means any information that can in itself either identify you as an individual (Personally-Identifying Information) or can be connected to you indirectly by linking it to Personally Identifying Information, such as:

  • Your account registration information on our website and in our app;
  • When you request any support from us or report a problem to us;
  • Information provided for using certain services or features;
  • Information from the completion of surveys or questionnaires;
  • Technical information, including the (IP) address used;
  • Your login information, browser, times zone settings, browser plug-in types and versions, operation system and platforms;
  • Details of any transaction, purchases and payments made on our website or app;
  • Your general interaction with the website, including the full uniform resources locators (URLs) clickstream to, through and from our website, products you have viewed or searched for, page response times, download errors, length of visits to certain pages and page interaction information;
  • Information received from third parties, such as business partners, sub-contractors, payments and delivered services and referrals by other users.

The Company also processes anonymous data, aggregated or not, to analyse and produce statistics related to the habits, usage patterns and demographics of consumers as a group or as individuals. Such anonymous data does not allow the identification of users to which it relates. The Company may share data, aggregated or not, with third parties for the improvement of user reachability.

Please be aware that the company may choose to permit third parties to offer subscription and/or registration-based services through the Company’s platforms i.e. mobile or web. The Company shall not be responsible for any actions or policies of such third parties and you should check the applicable privacy policy of such parties when providing personally identifiable information. By using the company’s platform, you have automatically given your consent to the company’s privacy policy. If you do not agree to the policy, please do not use the Company’s platform(s).

Why the Company Collects and Processes Data

The company collects and processes personal data for the following reasons:

  • Performing our agreement with you to provide content and services;
  • Providing, improving and developing our services;
  • Researching, designing and launching new features and products;
  • Providing you with alerts, updates, materials or information about our services or any other information requested or signed up for;
  • Compliance with legal and regulatory obligations;
  • Communicating with you and responding to your questions and requests;
  • Direct marketing especially for capacity building and training ads;
  • Purposes directly related or incidental to the reasons stated directly above; or
  • Where you have given consent to it.

These reasons for collecting and processing Personal Data determine and limit what personal data we collect and how we use it, how long we store it, who has access to it and what rights and other control mechanisms are available to you as a user.

WHAT DATA DO WE COLLECT AND PROCESS

Basic Account Data

When setting up an account, the Company will request your name, email address, telephone number and country of residence. You will also be required to choose a password. Your email or telephone number will serve as your username. The provision of this information is necessary to register a user account. You are responsible for keeping this password confidential and you must not share your password with anyone. During the account setup, the account will be automatically assigned a number (the “ID”).  This ID will be later used to reference your user account without directly exposing any Personally-Identifying Information about you.

Other data you explicitly submit

We will collect and process personal data whenever you explicitly provide it to us or send it as part of your communication with others e.g. in forums, chats or when you provide feedback or other user-generated content. This data includes:

  • Optional information such as Tax Identification Numbers/National Identification Numbers, Date of Birth, and Photo ID.
  • Information that you post, comment or follow on any of our services.
  • Information sent through chat or email.
  • Information you provide to request information to receive support from us or purchase services from us; including information necessary to process your orders with the relevant payment merchant.
  • Information you provide to us when participating in events or responding to surveys e.g. your contact details.

Your use of our website

We will collect a variety of information through your general interaction with websites, content and services offered by us. Personal data we collect may include but are not limited to, browser and device information, data collected through automated electronic interactions and application usage data. Likewise, we will track your process on our website and applications to confirm that you are not a robot and to optimise our services.

Your usage of services and other subscriptions

In order to provide you with right services, we need to collect, store and use various information about your activity in our content and services. Content-related information includes your ID, as well as information about your preference, progress and time spent as well as information about the device you are using, what operating system you are using, device settings, unique identifiers and crash data.

Tracking data and cookies

We use cookies, which are text files placed on your computer to help us analyse how our users use our services and other similar technologies (web beacons, pixels, advertisement tags and device identifiers). This is to recognise your device(s) that may be on or off across different devices and to improve our services, marketing, analytics and website functionality.

The use of cookies is standard on the internet. Although most web browsers automatically accept cookies, the decision to accept or not is yours. However, please note that if you do not accept our cookies, you may not be able to access the full functionality of our platform i.e. via the web. When you visit any of our services, our servers log your global IP address, which is a number that is automatically assigned to the network your computer is on.

Content recommendations

We may process information collected to ensure that content, products and services shown on the pages and in the update messages displayed when launching the service can be tailored to meet your needs and populated with relevant recommendations and offers. This is done to improve your overall customer experience.

Information required to detect violations

We collect certain data that is required for our detection, investigation and prevention of fraud, cheating and other violations of relevant laws (“Violations”). This data is used only for the purposes of detection, investigation, prevention and where applicable, taking necessary action on such violations. This data is only stored for the amount of time needed for this purpose. If the data indicates that a violation has occurred, we will store the data further, for the commencement and exercise of defence of legal claims during the applicable statute of limitation or until a legal case related to it has been resolved. Please note that the specific data stored for this purpose may not be disclosed to you if the disclosure will compromise the mechanism through which we detect, investigate and prevent such violations.

HOW WE STORE DATA

Period of storage

We will store your information for as long as necessary to fulfil the purposes for which the information is collected and processed or for a longer period of time where the applicable law provides for such. If you request to terminate your User Account, your Personal Data will be marked for deletion, except to the extent provided by law or other prevailing legitimate purposes. All your data and credits will be lost after deletion.

Deletion of data

In cases where Personal Data cannot be completely deleted in order to ensure the consistency of the system, the user experience or the community, your information will be permanently anonymised and your account will be deactivated. Please note that the Company is required under statutory commercial and tax laws to retain certain transaction data for a period of up to six (6) years. If you withdraw your consent to processing your Personal Data, we will delete your personal data without undue delay based on the withdrawal of consent. If you exercise a right to object to the processing of your Personal Data, we will review your objection and delete your Personal Data without undue delay, unless another legal basis for processing and retaining this data exists or unless applicable laws require us to retain the data.

Location of Storage

The data that we collect from you may be transferred to and stored locally or at a destination outside of your jurisdiction. It may also be processed by third parties who operate outside of your jurisdiction. By submitting your personal data, you agree to this transfer, storing and processing of data outside of your jurisdiction. We will take all steps reasonably necessary to ensure that your data is secured in accordance with this privacy policy.

WHO HAS ACCESS TO DATA

The Company and its subsidiaries may share your Personal Data with each other and use it to the extent necessary to achieve the purposes listed above. Reference to the company and its subsidiaries includes but is not limited to overseas offices, affiliates, business partners and counterparts (on a need-to-know basis only). In the event of a reorganisation, sale or merger, we may transfer your Personal Data to the relevant or proposed transferees of our operation (or a substantial part thereof) in any part of the world.

We may also share your Personal Data with our third-party provider that provides customer support services in connection with content and/or services distributed via our platform, especially for training recommendations. Your personal data will be used in accordance with this privacy policy and only as far as will be deemed necessary for the performance of customer support services. We may also share your information with our personnel, agents, advisers, auditors, contractors, financial institutions and service providers in connection with our operations or services; persons under a duty of confidentiality to us; or persons to whom we are required to make disclosure under the relevant laws and regulations in any part of the world.

In accordance with internet standards, we may also share certain information (including your IP address and the identification of content you wish to access) with our third-party network providers that provide content delivery, network services and server services in connection to us. Our content delivery network providers enable the delivery of digital content requested, by using a system of distributed servers that deliver the content to you based on your geographical location.

The Company will NOT allow you to link your user account to an account offered by a third party. This is to ensure that your professional data is isolated from your social accounts, thereby avoiding any nuisance that may hinder your ability to obtain our services professionally. Should there be a reason for a User Account to be linked to a third-party account for any reason (if mandated) or the transmission of information about your person from the company to a third party or vice versa, you will be informed about it before the linking takes place and you will be given the opportunity to consent to the linking and the transmission of your information. The third party’s use of your information will then be subject to the third party’s privacy policy, which we encourage you to review.

The Company may release Personal Data in compliance with court orders, instructions, and regulations requiring us to disclose such information.

We make certain data related to your User Account available to other users. This information can be accessed by anyone by querying your ID. At a minimum, the public persona name and general VORK profile you have chosen to represent you are accessible this way. The accessibility of any additional information about you can be controlled through your user profile/settings page; data publicly available on your profile page can be accessed automatically. While we do not knowingly share Personal Identifying Information about you such as your identification number or email address, any information you share about yourself on your public profile can be accessed, including information that makes you identifiable.

YOUR RIGHTS AND CONTROL MECHANISMS

You have the right to;

  • Check whether we hold personal data about you
  • Access any personal data we hold about you
  • Require us to correct any inaccuracy or error in any personal data we hold about you
  • Request for the deletion of your personal data through the deletion of your user account

CHILDREN

The minimum age to create a user account is Fifteen (15) years. The company will not knowingly collect Personal Data from any person below this age. To the extent that other countries may apply a higher age of consent for collecting personal data, the Company will require parental consent before a User Account can be created and personal data associated with it collected. The Company encourages parents to instruct their children to never give out personal information when online.

REVISION DATE

The Company reserves the right to change this policy at any time by notifying the users of the existence of a new policy statement. This policy is not intended to and does not create any contractual or legal rights on or behalf of any party.
